The New
York
State Sex
Offender
Registration Act allows us to determine whether an
individual is a convicted sex
offender
who is required to register.
Necessary
information:
To learn the status of an
individual, we must have the individual's name and at
least one of the following identifiers: the individual's
street address and apartment number, driver's license
number, social security number, or birth date. Additional
information (i.e., eye color, hair color, ethnicity,
height, weight, and distinctive markings) may be helpful
but is not required.
We will be able to determine whether an individual is
listed in the Registry. For offenders
who committed an act prior to enactment of the law
(January 21, 1996), we will only be able to verify that
the offender
has registered but no other information can be provided at
this time due to a Federal court injunction. If an offender's
name is listed on the Registry and the offender
committed an offense on or after January 21, 1996, we will
be able to provide the level of risk of re-offense by the offender
in question.
Offenders
Required to Register:
Anyone on parole or
probation or imprisoned for a sex
offense on January 21, 1996, to register with the Division
of Criminal Justice Services. In addition, sex
offenders
sentenced to probation, local jail, or state prison after
that date must register upon their return to the
community. In 1999, eight new
offenses were added to the list of registerable offenses.
Any person on parole or probation or imprisoned for one of
these offenses on January 1, 2000, as well as any person
who is convicted of one of the new
offenses after that date, must also register.
Information
Collected:
Aliases, date of birth, sex,
race, height, weight, eye color, drivers license number,
photograph, fingerprints, description of offense, date of
conviction, sentence imposed, internet accounts and
internet screen names, other pertinent information.
Timeframe
for Registration:
Upon release to the community
and within 10 days prior to change of address. This also
applies to out-of-State Offenders.
Duration
of Requirement:
For low risk (Level 1) to
moderate risk (Level 2) offenders:
must register annually for 10 years; for high-risk (Level
3) offenders:
must register annually for life.
Verification
of Address:
Annually; high-risk (Level 3) offenders
– every 90 days.
Penalties
for Non-Compliance:
Class A misdemeanor for the
first offense; Class D felony for second and subsequent
offenses. Non-compliance may be basis for revocation of
parole and probation.
Sex
offenders
are classified as either low risk (Level 1), moderate risk
(Level 2) or high risk (Level 3). This search will
not provide you with information about Level 1 or Level 2 offenders.
Anyone
who uses this information to injure, harass, or commit a
criminal act against any person may be subject to criminal
prosecution.

tell you if they are registered as a sex offender in your
